Terms of Use

The agreement between you and the developer of PopGrab.

1. Accepting these terms

By downloading or playing PopGrab you agree to these terms. If you do not agree, please do not use the game. Our Privacy Policy forms part of this agreement.

These terms are between you and Team Mio (“we”, “us”), the independent developer team that publishes PopGrab. A store listing may show a different name, because the stores display the name on the developer account; it is the same publisher, and section 16 is how to reach us. Apple and Google are not parties to these terms and are not responsible for PopGrab, though Apple and its subsidiaries are third-party beneficiaries of these terms on iOS and may enforce them against you.

2. Who can play

You must be at least 13 years old — or the minimum age of digital consent where you live, if that is higher — to play PopGrab. If you are under 18, you should read these terms with a parent or guardian.

3. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play PopGrab on devices you own or control, for your own non-commercial enjoyment. We keep all rights we do not expressly grant, including in the game's code, artwork, sounds, name and logo.

You may not sell, rent, sublicense or redistribute the game, remove or obscure any notices in it, or reverse engineer, decompile or disassemble it — except to the narrow extent that applicable law says you may despite this clause.

4. Accounts

PopGrab creates an anonymous account for you automatically so your progress has somewhere to live. You can play indefinitely without ever signing in.

Signing in with Google or Apple links that anonymous account to your provider identity so your progress survives a lost or replaced device. Keep control of the provider account you sign in with — anyone who can access it can access your PopGrab account.

If a provider account is already attached to a different PopGrab account, signing in takes you to that existing account rather than merging the two.

5. What PopGrab costs

Nothing. PopGrab is free to download and free to play, and there is nothing to buy inside it — no subscription, no in-app purchases, and no item or currency sold for money. You will never be asked for payment details, and we will never take a payment from you.

The game is paid for by the rewarded ads described in section 10. Watching one is always your choice: nothing you need in order to play sits behind an ad, and what they buy are extras — more time on a finished round, an extra AI Tuner remix, or a sound palette for a few days.

If that ever changes, it changes for new features and with notice under section 11. Anything you have already earned by playing stays yours to use.

6. Sparks and in-game items

Sparks, levels, tiers, power-ups and any other in-game item are a licence to use a feature of the game. They are not your property, have no monetary value, and cannot be exchanged for money or transferred to anyone else. We may change what they do, what they cost, or how they are earned, as part of balancing the game. If your account is closed for a breach of these terms, unused items are forfeited.

7. The AI Tuner

The AI Tuner generates a tune from a short description you write. It is generated automatically, and we do not promise it will be good, original, or anything in particular. Use is limited by an allowance shown in the editor: a few remixes each week cost nothing, and further ones ask you to watch a rewarded ad. We may adjust either limit.

You agree not to enter prompts that are unlawful, that contain another person's personal information, or that attempt to make the system produce harmful or infringing content. We may refuse or stop a request.

As between you and us, tunes you generate are yours to use in the game. Similar prompts can produce similar tunes for other players, so we cannot and do not grant you exclusivity over anything the AI Tuner produces.

8. Tunes you make

Tunes you compose in the editor are yours. By backing one up you give us a non-exclusive, worldwide, royalty-free licence to store, copy and transmit it purely for the purpose of running the backup and playing it back to you. That licence ends when you delete the tune or your account. We do not use your tunes for anything else, and we do not publish them.

9. Fair play

Please do not:

• modify the game, use cheats or automation tools, or tamper with scores or allowances;
• submit scores you did not earn by playing, or otherwise manipulate the leaderboards;
• attempt to access another player's account or data;
• probe, overload or interfere with our servers, or use the game to break any law;
• choose a display name that is offensive, impersonates someone, or infringes a trademark.

We may remove leaderboard entries we believe were not earned legitimately.

10. Advertising

Advertising is what pays for PopGrab. Every ad in the game is a rewarded ad you choose to watch in exchange for something — there are no banners, no ads between screens, and none when the game opens. We do not control the content of third-party ads and are not responsible for what they advertise or link to. How advertising data is handled is covered in the Privacy Policy.

11. Changes to the game and these terms

We may add, change or remove features, and we may update these terms. If a change is material we will give reasonable notice in the app or by email. Continuing to play after a change takes effect means you accept the updated terms; if you do not accept them, stop using the game and — if you wish — ask us to delete your account.

12. Suspension and termination

You may stop playing at any time and ask us to delete your account. We may suspend or close an account that breaches these terms, or where we must do so by law, and we will tell you why unless the law prevents us.

13. Disclaimers

PopGrab is provided "as is". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the game will be uninterrupted, error-free, or that cloud backup will always succeed — please do not treat it as your only copy of anything you care about.

Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, you keep all statutory rights that these terms cannot lawfully limit.

14. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, for lost profits, or for lost data or progress. PopGrab is free and you pay us nothing, so our total liability arising out of or relating to it is limited to USD 50.

15. Governing law

These terms are governed by the laws of Bangladesh, and the courts of Bangladesh have exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country, or of the right to bring proceedings in your local courts.
